TERMS & CONDITIONS

Please read this agreement entirely and carefully.  On confirmation of your order and payment of deposit with Martin & Cox you agree to be bound by the terms and conditions below.

1. CONFIRMATION

1.1 Confirmation is required 14 days from the date of receipt of your estimated quote.  If confirmation has not been received after this time Martin & Cox reserve the right to make the wedding/event date available to other clients.

2. PAYMENT, CHANGES & CANCELLATION

2.1 A £50.00 non refundable deposit is payable at the time the quote is accepted and agreed by yourself.  This will be deducted from the final bill.  This should be received no later than 14 days after confirmation.

2.2 The remaining balance will be invoiced to you at least one month before the wedding/event date and must be paid and cleared no later than 14 days before the wedding/event date.

2.3 Martin & Cox reserve the right to cancel the booking if payment agreements are not met and any deposit paid will not be refunded.

2.4 Once all monies are received should the wedding/event be cancelled the following amounts are refundable:

6 months or more before event date – deposit retained and no further payment required

2-5 months before the event date – deposit retained and an admin fee of £100.00

less than 2 months before the event date – deposit retained  and 50% of the final amount payable 

2.5 We will accept minor changes to flowers and sundries ordered up to 5 weeks before the wedding/event date before the client has received the final bill.  We cannot guarantee we can accept changes after that time but will use our best endeavors to accommodate such requests.

2.6 Subsequent consultations, paperwork, changes and revised estimates associated with major design changes will be charged at £25.00 per hour payable on invoice.   This is only applicable to clients who have already accepted the original quote.

2.7 All effort will be made by Martin & Cox to supply the products agreed upon at the time of the booking.  However Martin & Cox will not be held responsible if the products are not 

available as a result of but not limited to unavailability, seasonal variation or poor quality.  Martin & Cox reserve the right to use it’s discretion to supply similar or substitute high quality product under such circumstances and will try where possible to agree this alternative with you prior to supply.

2.8 After acceptance of the quote and payment of the deposit Martin & Cox organize their workload accordingly to reflect staff and workload.  This will impact Martin & Cox taking on any other work on the proposed date.  Therefore after acceptance the client will only be able to reduce the final order by no more than 10% of the original quote.  This is non-negotiable.

2.9 Martin & Cox have a minimum spend of £500.00 this does not include delivery charges.

3. ACCESS & INSTALLATION ARRANGEMENTS

3.1 Where it is necessary for us to install flowers or other products we will agree to arrange access at specific and agreed times with venue representatives.  It is your responsibility to supply Martin & Cox with accurate detailed contact information for these representatives.  If for any reason we are unable to obtain access at the agreed times we cannot guarantee the completion of the installation by the agreed times.  We confirm that we will use our best endeavors to meet the timetable.  We cannot accept liability for any possible costs occurred due to us being unable to access the premises at the agreed times which have been out of our control.

3.2 When installing the flowers if for any reason the venue representatives refuse Martin & Cox to position or use pre-arranged area of the venue to display the flowers or products all efforts will be made to rectify this, however Martin & Cox will respect the venue’s decision and position or install the flowers in the next most suitable area/position.

3.3 Martin & Cox request that we are the sole provider of floral arrangements and/or fresh flowers and foliage décor.  If you wish to add your own arrangements please notify us.  Please note other than church floral teams we will not work or partner with any other provider of floral décor for your event.  This is non-negotiable.

4. PHOTOGRAPHS

4.1 You agree that any photographs of our flowers or products taken by us at your wedding/event may be displayed on our website, social media or portfolio.  In the event that individuals are pictured we will seek your consent to display the photographs.

5. DELIVERY

5.1 It is your obligation to provide the correct and completed address details.  Should you provide the wrong address Martin & Cox are not obliged to re-deliver the order to the correct address at our expense. If the incorrect delivery address is supplied or if there is no one to 

receive and no safe place (as judged by us) to leave the ordered products they will be returned to Martin & Cox premises and we will contact you to rearrange re-delivery.  Re-delivery may occur an additional fee.  To avoid these costs please carefully consider the delivery address you provide.

5.2 Martin & Cox do not accept responsibility for completing set ups at a ceremony or reception venue if the venue is not ready at the pre-agreed time.  Under these circumstances we will use our discretion to leave the products at the venue (if the venue is willing to complete the set-up) or we will return the items to our premises for you to collect should the venue not comply.  However this is very unlikely that Martin & Cox will ever leave a venue without personally setting up.  This will only ever happen in extreme circumstances.  

5.3 Martin & Cox are unable to give guaranteed time of delivery but will endeavor to deliver at the agreed time.  Without limiting the operation of the Terms and Conditions you agree that late delivery does not constitute a failure of our agreement and does not entitle you to cancellation or refund of an order.

5.4 Martin & Cox will not accept liability for any loss or damage arising from items lost, stolen or damaged after delivery has taken place.  A signature is required upon receipt of delivery either by yourself or on your behalf.  Please ensure the order is correct before signing and any mistakes or queries must be raised within 30 minutes of receiving your order and we will endeavor to assist.

5.5 Charges for van hire may be incurred dependant on the size/scale of your wedding.  This will be added on to your final invoice.  Martin & Cox will always endeavour to use own vehicles.  The charge is non-negotiable and can be requested if liable prior to receiving invoice.

5.6 A delivery charge will be added to your final bill.  This cost will not be included in your estimated quote.  Delivery charges are calculated at a cost of 60p per mile.  Any journeys over 1 hour will incur an additional £25.00 for each hour.  The delivery charge covers the cost from Martin & Cox premises to the agreed addresses and return travel. 

6. RETURNS & EXCHANGES

6.1 While Martin & Cox will abide by the applicable law in relation to the supply of it’s products no exchanges or refund (unless at our discretion) will be accepted if you change your mind.  We believe our product is of the highest quality and hope that you agree after receiving our products.  There is no money back guarantee however we do care about our customers and will deal with each situation on a case by case basis.  If you are dissatisfied for any reason please don’t hesitate to contact us.

7. DISCLAIMER - ILL HEALTH, ACTS OF GOD OR ADVERSE WEATHER CONDITIONS

7.1 Whilst we agree to use our reasonable endeavors to ensure that Martin & Cox service is fully operational and effort free we cannot guarantee this.  Acts of God, sudden ill health and adverse weather conditions may affect our ability to deliver the Martin & Cox product or service.  However in cases of adverse weather we will remain in contact with the client in the lead up to the event and if the event is out of season we will discuss a contingency plan with the event organizer.  We have contingency plans for such occasions of sudden ill health if Martin & Cox is unable to personally complete or deliver your event then this will be completed by an outsourced third party.  Ultimately we can accept no responsibility for Acts of God, sudden ill health or adverse weather conditions and if we are prevented from providing the Martin & Cox service or product as agreed then we can only offer a refund for the full monies paid.

8. GENERAL

8.1 We reserve the right to supplement and amend the terms and conditions of Martin & Cox product or service from time to time.  We will inform the client of any changes to the Martin & Cox terms and conditions and forward on the revised terms and conditions.

8.2 Additionally we reserve the right to suspend, restrict or terminate Martin & Cox products or services for any reason at any time.
